The following Terms and Conditions of Sale (these “Terms”) apply to all purchases, orders, sales transactions, promotions, returns, and related interactions between you, the customer (“you” or “Customer”), and Silver Shadow US Corp. (“Silver Shadow US,” “we,” “us,” or “our”) through our website, online store, checkout process, customer service channels, and any other online sales channel operated or authorized by Silver Shadow US (collectively, the “Site”).

By placing an order, completing checkout, accepting these Terms, creating an account, using the Site, or purchasing any product from Silver Shadow US, you agree to be bound by these Terms. If you do not agree to these Terms, do not place an order or purchase products through the Site.

We reserve the right to revise these Terms at any time. All purchases are subject to the Terms in effect at the time your order is placed or, if required by law or presented at checkout, the Terms accepted by you at checkout. You should review these Terms each time you purchase products through the Site.

1.​Eligibility; Legal Compliance. You are solely responsible for determining whether any product you purchase from Silver Shadow US may lawfully be purchased, possessed, received, owned, transferred, transported, used, or resold by you under all federal, state, local, and other laws applicable to you. By placing an order, you represent and warrant that: (a) you are legally permitted to purchase, possess, receive, own, and use each item in your order; (b) your purchase, receipt, possession, ownership, and use of the products will not violate any applicable law, regulation, ordinance, restriction, or court order; (c) you are not prohibited from purchasing, possessing, or receiving the products; and (d) all information you provide to Silver Shadow US is true, accurate, current, and complete.

2. Age Requirements. By placing an order, you certify that you meet all applicable age requirements for the products purchased. Without limiting the foregoing, you certify that you are at least twenty-one (21) years old. Silver Shadow US may cancel any order if we cannot verify eligibility or if we determine that the order may violate applicable law or these Terms. 

3.​ Firearm Sales; Conditional Orders. All firearm sales, and all sales of products that must be transferred through a federal firearms licensee or other licensed dealer, are conditional and subject to all applicable legal requirements. When you order a firearm or other regulated product through the Site, you must designate an appropriate federal firearms licensee or other licensed or authorized dealer (“FFL Dealer”) to receive the product, unless otherwise permitted by applicable law and approved by Silver Shadow US.

4.​ FFL Dealer Delivery and Transfer. After your order is placed, accepted, and paid for, Silver Shadow US or its fulfillment partner may ship the regulated product to the designated FFL Dealer. You must retrieve the product at the physical location of the designated FFL Dealer and complete all background checks, forms, waiting periods, fees, identification requirements, and other requirements imposed by the FFL Dealer or applicable law. Title to any firearm or regulated product shall not pass to you, and the product shall not be deemed delivered to you, until the FFL Dealer lawfully transfers and releases the product to you.

5.​ Denied, Delayed, Refused, or Incomplete Transfers. If you fail a background check, fail to complete required paperwork, fail to satisfy any legal or dealer requirement, provide inaccurate or incomplete information, designate an unavailable or invalid FFL Dealer, fail to retrieve your order, or are otherwise unable or unwilling to take lawful delivery of a firearm or regulated product, Silver Shadow US may cancel, void, refund, restock, reship, or otherwise process the order in accordance with our then-current policies and applicable law. Any refund may be reduced by shipping, insurance, handling, payment processing, return shipping, storage, restocking, FFL transfer, and other third-party or administrative costs incurred in connection with the order.

6.​ FFL Dealer Independence. FFL Dealers are independent third parties. No FFL Dealer is an agent, employee, partner, joint venturer, representative, or authorized spokesperson of Silver Shadow US. No FFL Dealer has authority to bind Silver Shadow US or make any representation, promise, warranty, or agreement on behalf of Silver Shadow US. Silver Shadow US is not responsible for the acts, omissions, policies, procedures, fees, delays, refusal to transfer, business hours, recordkeeping, or decisions of any FFL Dealer.

7.​ Order Processing; No Modification After Submission. We may begin processing your order as soon as it is placed. Orders may not be modified, altered, combined, substituted, or cancelled after submission unless Silver Shadow US expressly agrees in writing or unless cancellation is required by applicable law. We may reject, cancel, or limit any order for any reason, including product unavailability, pricing or description errors, suspected fraud, compliance concerns, shipping restrictions, payment issues, or violation of these Terms.

8.​ Product Information; Pricing; Availability. Product descriptions, photographs, specifications, availability, pricing, promotions, configurations, and other information on the Site are subject to change without notice. Photographic, typographic, descriptive, pricing, and technical errors are unintentional and may be corrected at any time. We reserve the right to cancel or adjust any order affected by an error, unavailability, or compliance concern. No refund, credit, price adjustment, raincheck, or special order is required for any sale, promotion, price change, discontinued item, or change in product availability unless expressly approved by Silver Shadow US or required by law.

9.​ Payment. All orders must be paid in United States dollars through a payment method accepted by Silver Shadow US at checkout. By submitting payment information, you represent and warrant that you are authorized to use the payment method provided and authorize us and our payment processors to charge all amounts due in connection with your order, including product charges, shipping, insurance, taxes, handling charges, FFL-related charges if collected by us, and any other charges disclosed or authorized at checkout. Orders are not accepted until payment has been authorized and the order has been accepted by Silver Shadow US.

10.​ Shipping; Risk of Loss; Carrier Delays. Shipping times, delivery dates, and tracking information are estimates only and are not guaranteed unless expressly stated in writing by Silver Shadow US. We are not responsible for carrier delays, carrier errors, weather events, lost or stolen packages after delivery confirmation, incorrect addresses supplied by you, FFL Dealer delays, or other events outside our reasonable control. Certain products may not be shipped to certain jurisdictions, addresses, P.O. boxes, carrier locations, territories, or other restricted destinations. You are responsible for ensuring that the delivery destination and any designated FFL Dealer are legally permitted and operationally able to receive the products ordered.

11.​ Shipping Costs; Insurance; Fees. Unless expressly stated otherwise at checkout or in a written promotion, you are responsible for all shipping, insurance, handling, taxes, FFL transfer fees, storage fees, return shipping, and other charges associated with your order. Shipping, insurance, handling, FFL transfer fees, and other third-party charges are non-refundable unless required by law or expressly approved by Silver Shadow US.

12.​ General Return Policy. All sales are final and no repairs or returns will be handled outside of Silver Shadow US’s warranty policy. While items are not eligible for return, Silver Shadow US is committed to its customers’ 100% satisfaction. Please contact Silver Shadow US for more information. For warranty returns and replacements, products must be complete, unaltered, undamaged, unused except for ordinary inspection, and returned with all components, accessories, packaging, manuals, documentation, proof of purchase, and return materials required by Silver Shadow US. We may reject any return if the product is damaged, altered, incomplete, missing components, missing packaging, used beyond permitted inspection, improperly packaged, lost, stolen, restricted, regulated, or otherwise noncompliant with these Terms or our return instructions.

13.​ Return Authorization; Inspection; Processing. No warranty return, repair, or replacement will be processed unless you follow Silver Shadow US’s return procedures and obtain any required return authorization. No replacement or exchange will be issued until we receive, inspect, process, and accept the returned product and all required return materials. Typical processing times may vary. We are not responsible for late, lost, stolen, misdirected, or damaged return shipments. You are responsible for properly packaging returned products, complying with all laws applicable to return shipment, and obtaining any desired shipping insurance.

14.​ Non-Returnable and Restricted Items. Certain products may be non-returnable or subject to special return restrictions, including firearms after transfer, ammunition, serialized or regulated products, custom products, special orders, clearance items, final-sale items, used items, installed parts, altered products, hazardous materials, products missing required components or packaging, and any other product identified as non-returnable at checkout, on the product page, or in our return instructions. Firearms must be unloaded before any return shipment. No ammunition may be included in the same package as a firearm. You are solely responsible for complying with all applicable laws and carrier requirements when returning any regulated product.

15.​ Superstacks and Bundles. Silver Shadow US may offer product combinations, promotional packages, discounted packages, kits, sets, gifts-with-purchase, credits, rebates, or other combined offers referred to as “Superstacks,” “Bundles,” or similar names. A “Superstack” or “Bundle” means two or more products, components, accessories, services, promotions, discounts, credits, gifts, rebates, or other items sold together, marketed together, discounted together, or otherwise priced as a package or combined offer.

16.​ Promotional Items; Gifts; Credits; Rebates. If a Superstack, Bundle, promotion, or discounted transaction includes any free or discounted item, gift, store credit, rebate, coupon, loyalty credit, or other promotional benefit, Silver Shadow US may require the promotional item or benefit to be returned, cancelled, reversed, or deducted from any refund. If you keep any promotional item or benefit, its full non-discounted retail value or stated promotional value may be deducted from any refund.

17. ​Firearms Safety. If you purchase, receive, possess, handle, transport, store, or use any firearm, ammunition, component, accessory, or related product, you are solely responsible for doing so safely and lawfully. You certify that you understand and will follow all applicable firearms safety rules, including: always keep firearms pointed in a safe direction; keep your finger off the trigger until ready to shoot; keep firearms unloaded until ready to use; know your target and what is beyond it; use only correct ammunition; wear appropriate eye and ear protection; never handle firearms while impaired; store firearms securely and away from unauthorized persons; and comply with all laws governing access to firearms by minors or prohibited persons.

18.​ Export Controls; Restricted Parties and Destinations. Certain products may be subject to export control laws, sanctions, restricted-party rules, embargoes, or other transfer restrictions. You agree not to export, re-export, transfer, divert, ship, carry, or otherwise provide any product purchased from Silver Shadow US to any restricted person, restricted destination, embargoed country, or prohibited end use without all required government authorizations. You are solely responsible for complying with all applicable export control, sanctions, and transfer laws.

19.​ Product Use; Alterations. Silver Shadow US is not responsible for unauthorized alterations, modifications, misuse, abuse, negligent handling, improper installation, improper maintenance, unsafe storage, illegal use, or use of products with incompatible components, ammunition, accessories, or equipment. Any such conduct may void warranties, make products unsafe, and affect return eligibility.

20.​ Manufacturer Warranties; Silver Shadow US Warranty Disclaimer. Products sold through the Site may be covered by manufacturer or supplier warranties. Silver Shadow US may provide available warranty information where practicable, but Silver Shadow US does not independently manufacture all products sold through the Site and does not provide any independent product warranty unless expressly stated in writing by Silver Shadow US. To the fullest extent permitted by law, products are sold subject to the applicable manufacturer’s or supplier’s warranty, if any, and otherwise “as is” and “as available.”

21.​ Limitation of Liability. To the fullest extent permitted by law, Silver Shadow US’s maximum liability arising out of or relating to any order, product, transaction, return, warranty claim, Site use, or these Terms shall not exceed the amount actually paid by you to Silver Shadow US for the product or transaction giving rise to the claim. To the fullest extent permitted by law, Silver Shadow US shall not be liable for any incidental, consequential, indirect, special, exemplary, punitive, or similar damages, including lost profits, loss of use, loss of data, loss of goodwill, business interruption, or other economic loss, whether based on contract, tort, warranty, statute, strict liability, or any other theory.

22.​ Indemnification. You agree to defend, indemnify, and hold harmless Silver Shadow US and its officers, directors, employees, agents, representatives, affiliates, successors, and assigns from and against all claims, demands, actions, losses, damages, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) your breach of these Terms; (b) your purchase, possession, transfer, storage, transportation, modification, resale, export, or use of any product; (c) your violation of applicable law; (d) your inaccurate or incomplete information; (e) your failure to satisfy FFL Dealer or legal transfer requirements; or (f) your negligence, willful misconduct, or misuse of the Site or any product.

23.​ Site Content; Intellectual Property. All Site content, including text, images, graphics, logos, product listings, descriptions, designs, software, and other materials, is owned by Silver Shadow US or its licensors, suppliers, or content providers and is protected by intellectual property laws. You may use the Site only for lawful personal or commercial purchasing purposes as authorized by Silver Shadow US. You may not copy, scrape, reproduce, distribute, modify, display, sell, or exploit Site content without our prior written consent.

24.​ Accounts; Security; Accurate Information. If you create an account or submit information through the Site, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to promptly update it as needed. We may suspend or terminate accounts, refuse service, cancel orders, or restrict access to the Site if we suspect fraud, misuse, legal noncompliance, inaccurate information, or violation of these Terms.

25.​ Promotions; Coupons; Discounts. Promotions, coupon codes, discounts, giveaways, sweepstakes, store credits, and similar offers are subject to the terms stated with the applicable offer. Unless expressly stated otherwise, promotions are valid only while supplies last, may not be combined with other offers, have no cash value, may be changed or cancelled at any time, and may be subject to eligibility, geographic, product, or time limitations. In the event of a conflict between these Terms and promotion-specific terms, the promotion-specific terms control for that promotion.

26.​ Communications. By providing your email address, phone number, billing address, shipping address, or other contact information, you authorize Silver Shadow US to contact you regarding your account, orders, payments, shipping, returns, recalls, compliance issues, customer service, promotions, and other matters related to the Site or your transactions. You are responsible for ensuring that your contact information is accurate and current.

27.​ Privacy. Our collection, use, and disclosure of personal information are governed by our privacy policy, if posted on the Site, and by applicable law. By using the Site or placing an order, you consent to the collection, use, and disclosure of information as necessary to process orders, verify eligibility, facilitate FFL transfers, prevent fraud, comply with law, provide customer service, administer returns, and operate the Site.

28. ​Governing Law. These Terms, your use of the Site, and all purchases from Silver Shadow US shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles that would require the application of the laws of another jurisdiction.

29.​ Venue and Jurisdiction. Subject to any arbitration provision or other dispute-resolution provision adopted by Silver Shadow US and presented to you, any claim, action, or proceeding arising out of or relating to these Terms, the Site, or any purchase from Silver Shadow US may be brought only in the state or federal courts located in the State of Florida having jurisdiction over the geographic area in which Silver Shadow US is located. You consent to personal jurisdiction and venue in those courts and waive any objection to such jurisdiction or venue.

30.​ Changes to Terms. Silver Shadow US may change these Terms at any time without prior notice by posting revised Terms on the Site or presenting revised Terms at checkout. Revised Terms apply to purchases and Site use after the revised Terms are posted or presented, except as otherwise required by law.

31.​ Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid, illegal, or unenforceable provision will be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent as closely as possible.

32.​ No Waiver. No failure or delay by Silver Shadow US in exercising any right, remedy, or provision under these Terms shall operate as a waiver. Any waiver must be in writing and signed by an authorized representative of Silver Shadow US.

33.​ Assignment. You may not assign, transfer, or delegate any rights or obligations under these Terms without the prior written consent of Silver Shadow US. Silver Shadow US may assign or transfer these Terms, in whole or in part, to an affiliate, successor, purchaser, or other third party in connection with a business transaction, reorganization, merger, sale of assets, or operation of the Site.

34.​ Entire Agreement. These Terms, together with any applicable checkout terms, product-specific terms, return instructions, promotion-specific terms, privacy policy, and other policies posted or presented by Silver Shadow US, constitute the entire agreement between you and Silver Shadow US regarding your use of the Site and purchase of products from Silver Shadow US.

WARRANTY POLICY

All Silver Shadow US products are manufactured using the finest quality materials and have a limited lifetime warranty.  All firearms are warrantied to be free from defective materials and workmanship.  Silver Shadow USA will repair or replace only those parts as determined to be defective by the factory.  This warranty is limited and does not extend to “Wearable” or “Consumable” parts, careless handling, abuse and misuse, unauthorized adjustments or modifications, use of improper ammunition, excessive or unreasonable use, rust or corrosion or barrel obstruction.

 Altering or modifying parts is dangerous and will void the warranty. Your firearm was manufactured to perform properly with the original parts as designed. It is your responsibility to make sure any parts you install are made for this firearm, installed correctly, and that neither the originals nor the replacement parts are altered or changed. Your firearm is a complex precision tool with many parts that must operate correctly with other parts in order to maintain proper and safe operation. Putting your firearm together improperly or with incorrect or modified parts can result in a damaged firearm, serious personal injury, or death to you and/or others through malfunction. Always have a qualified armorer or gunsmith work on your firearm systems or other firearms.

Shipping to and from our facilities, government fees, damages caused by failure to perform normal maintenance, sales outside the United States, damages due to high velocity, high pressure, reloaded, remanufactured, or other no non-standard ammunition, consequential or incidental damages and /or expenses, any unauthorized repair, modification, misuse, abuse, or alteration of the product is not covered by this warranty.

It is the responsibility of the owner to assure the weapon is properly maintained. 

"WEARABLE" OR "CONSUMABLE" PARTS

Silver Shadow US has been manufacturing firearms and firearm components since 1995. Through extensive testing and use we have learned that almost any machine including all firearms will have certain parts that could occasionally require maintenance, adjustments or replacement.  “Wearable” or “Consumable” parts are those parts that by their very nature, through use (functioning) will not maintain absolute factory specifications forever and will need to be monitored periodically for functionality and safety. Some of these parts may have a finite life cycle which could be affected by use, abuse, or maintenance.

To address these parts on our products, it is recommended that a Silver Shadow US firearm must be disassembled and inspected by a certified Silver Shadow USA armorer at least annually. Many of the problems that the factory has encountered with customer’s returned firearms involve these “Wearable” or “Consumable” parts and or improper maintenance or cleaning. 

Springs are very important to the safe and reliable operation of any firearm. They tend to be one of the most overlooked parts when performing maintenance. When they become worn through use or age they tend to anneal or take a set (become weak). This can change or adversely affect the operation or reliability of the firearm.  In addition, any spring can be damaged, weakened, worn, or broken based on the use or abuse of the firearm and therefore should be inspected regularly and replaced as needed.

Extractors are a high use component that must function correctly every time the firearm feeds or extracts a cartridge from the chamber to complete the cycles of operation. Because of this they are considered a “Wearable” part and should be inspected regularly and replaced as needed.

Ejectors are also a high use component that must function correctly every time the firearm ejects a cartridge from the chamber. Because of this they are considered a “Wearable” part and should be inspected regularly and replaced as needed.

Op-Rods operate any time the firearm is cycled. Again, depending on the use or abuse of the firearm this part can be subjected to high impact stress and should be inspected regularly and replaced as needed.

The Firing Pin contacts the cartridge primer anytime a round is loaded and anytime the firearm is fired. This can cause impact stress to the face of the Firing Pin and therefore it should be inspected regularly and replaced as needed.

A Cam Pin is a crucial component that operates every time the firearm is cycled and is the main component that locks and un-locks the action. This part is a high cycle component and therefore should be inspected regularly and replaced as needed.

 PARTS POLICY

Our Service Department maintains a full complement of replacement parts.  Even though most gunsmiths have the knowledge, training, and the ability to make necessary repairs to your firearm, the skill and workmanship of any particular 3rd party gunsmith is totally beyond our control. Should your firearm ever require service, we strongly recommend that you return it to Silver Shadow US.  A firearm is a precision instrument, and some replacement parts will require individual fitting to ensure correct operation.  A wrong part, improper fitting, or incorrect mechanical adjustment may result in an unsafe condition or dangerous malfunction, damage to the firearm, or cause possible serious injury to the shooter or others. Silver Shadow USA parts may only be installed in conjunction with: 1) Other parts that were designed and/or sold by Silver Shadow US or 2) Parts that adhere to the safety and functional dimensional requirements of the M16, M4 carbine, or any subsequent variant military specifications or data packages.

SILVER SHADOW US IS NOT RESPONSIBLE FOR THE FUNCTIONING OF ANY FIREARM IN WHICH REPLACEMENT PARTS ARE INSTALLED BY OTHERS. REPLACEMENT PARTS MUST BE PROPERLY INSTALLED AND FITTED BY A QUALIFIED GUNSMITH OR CERTIFIED POF-USA ARMORER TO ENSURE THE SAFE AND RELIABLE OPERATION OF YOUR FIREARM.




Third-Party Product Warranties

Products manufactured by third parties are subject solely to the warranty, if any, provided by the original manufacturer. Any warranty claims, defects, repairs, replacements, or related issues concerning third-party products must be handled directly with the applicable manufacturer in accordance with its warranty terms and procedures. Silver Shadow does not provide or extend any additional warranty for third-party products unless expressly stated otherwise.
